I was in a car accident, both cars were totalled. I suffered severe Whiplash
had head pain and neck stiffness for over 1 week. Currently still get headaches and neck aches. I am wondering if anyone has had this and what amount is usual for this type of injury
There no way to put an exact number on you should ask a lawyer for an opinion. If you submit your case to http://www.selectcounsel.com your case will be reviewed and one of the best lawyers in your area will be put in contact with you to take your case for free.
Whiplash – Metallica Moscow 1991
As a part of the Monsters of Rock tour, Metallica performs a free concert in Moscow at the Tushino Airfield, before a crowd estimated between 750,000 and 1.6 million people. Legend has it that the the President of the Soviet Union Mikhail Gorbachev personally invited the band to play at the concert. The concert features also AC/DC and Pantera. More than 1,000 militiamen are on guard around the stage, and more are hidden in trucks parked further away. Their violent methods of controlling crowds leave 53 people injured.
Bands on bill: AC/DC, Metallica, E.S.T., Black Crowes, Pantera
Setlist:
Ecstacy of Gold
Enter Sandman

In term of Newton’s first law (the law of inertia), how does a car headrest help to guard against Whiplash in a rear-end collision?
First law
There exists a set of inertial reference frames relative to which all particles with no net force acting on them will move without change in their velocity. This law is often simplified as "A body persists its state of rest or of uniform motion unless acted upon by an external unbalanced force." Newton’s first law is often referred to as the law of inertia.
Your body is shoved forward when you are hit from behind while in your car. Since your head is not touching the back of the seat it won’t be pushed forward as fast and tends to keep traveling at the old rate of speed so it looks like it is going backwards. Really, it just isn’t going forwards as fast as the rest of your body is. The headrest keeps your head from going back any further than the headrest, hyper-extending your neck. So the headrest starts pushing your head forward at the same speed as your body, keeping them aligned.

Using Newton’s laws of motion, what happens during the car accident to give you Whiplash?
Okay, let’s get gross.
From the physics perspective, momentum is transferred from the offending vehicle to your car. Momentum equals "mv", and since the mass "m" of the car is constant, this means that "v" increases.
The rate at which "v" increases depends upon the violence of the collision. However, let’s say that it happens over some time frame "t". The acceleration "a" equals delta-v (the change in velocity) divided by t².
Now your head is subjected to acceleration just like the rest of the car. The force exerted on your head is given by the equation F=ma, where "m" in this case is the mass of your head and "a" is the acceleration. Your muscles must compensate for this force, or your head will snap back.
(End of serious question… now the fun part)
Your neck has a certain modulus of elasticity. If the force applied to your neck is below the modulus of elasticity then after snapping back your head will bungee forward and plant itself into the steering wheel. Hopefully you are not smoking a pipe at the time.
If the force is above the modulus of elesticity but below the modulus of rupture, your head will just sort of loll backwards at a crazy angle, dangling limply from your neck and stuck between your back and the seat.
If the force is above the modulus of rupture your head will be ripped off and will fly toward the back window.
As your head flies toward the back window, leaving behind a spouting stump, you have a couple of seconds to consider whether the collision with the window will be inelastic or elastic. If it is elastic then your severed head will rebound and end up back in your lap. If on the other hand it is inelastic, your head will deform against the glass like a piece of squished putty, giving the EMT’s something really gross to photograph and hang in their lockers.
"And that is all I have to say about that".
Is whiplash possible/probable in front on collisions, if so are there any differences. Furthermore if no injuries were reported at the scene of accident and the police officer recorded this is it still possible to gain compensation? And finally if somebody is trying to gain compensation how does the ‘offender’ know whether they are telling the truth or whether they are even to blame?
Let’s break it down:
1. Whiplash is possible in any kind of collision. While it’s true that most whiplash injuries occur when being struck from the rear, it can also happen in a front-end collision or a side collision.
2. Even if you don’t report an injury to the police at the time of the incident, you can still get compensation. Most people don’t realize they’re injured until a day or so later. In order to get compensation, you’d have to see a doctor and be referred to a specialist. The specialist would have to diagnose your injury and say that the proximate cause of your injury was the car accident.
3. Whiplash cases are a major pain. It’s very easy for someone who is not hurt at all to see a doctor and claim a Whiplash injury if they say the right things. Furthermore, many whiplast injuries are soft-tissue injuries, which are very hard to prove or disprove. This is where the insurance companies weigh in. Let’s say you were in an accident and the police officer determined you were at fault. The other person claims a whiplash injury. Your insurance company would step in and handle the claim for you, and they’d put their crack team of lawyers on it to decide whether the claim is worth paying or if they should go to court.
Does that help?
“Whiplash” is the sixth track and first single from Kill ‘Em All. It is credited to Hetfield and Ulrich. The song is mostly about the feeling one gets from headbanging. “Bang your head against the stage”, “Make it ring, make it bleed, make it really sore” and “You’re thrashing all around…acting like a maniac” are examples of this.
Often in concert, Hetfield changes the original lyric from “But we’ll never stop, we’ll never quit, ’cause we’re Metallica” to “But we’ll never stop, we’ll never quit, ’cause you’re Metallica” emphasizing that it is the fans who’ve made Metallica what they are. In live performances, Jason Newsted often sang for part or all of the song, notably in recorded footage in San Diego, California. He also sang it without Hetfield on the stage July 12, 2000, at Mile High Stadium in Denver as well as July 14, 2000 in 3Com Park San Francisco. Hetfield was icing down a recently injured back while Hammett, Newsted and Ulrich performed.[9]
A number of covers of this song have been performed. In 2005, Motörhead won their first Grammy for the cover of this song on a Metallica tribute album. “Whiplash” is also on Tony Hawk’s Underground 2 and Guitar Hero: Metallica. It was also covered by Billy Milano, Scott Ian, Phil Soussan, and Vinny Appice for Metallic Assault: A Tribute to Metallica, while Pantera, using the joke name “Pantallica”, performed the song live with Newsted on bass, and members Dimebag Darrell (guitar) and Philip Anselmo (vocals) switching instruments.[10]
During the Live version of this song, Hetfield counted off random numbers to start the song. Instead of saying “1, 2, 1, 2, 3, 4″, he said “1, 2, 4, 3, 2 and a half!”.[11]

Hello all!
I’m ready to settle a claim. Everything is going to be paid for- repairs, hospital bills, chiropractor, etc. However, I have to negotiate the amount I get back for pain and suffering.
Back a few years ago, I got Whiplash but didn’t have to go to the chiropractor and got only $500 for my pain and suffering…
With this accident, I had to go approximately 12-15 times. So, I’m wondering what my state maximum might be for my case.
Ohio may or may not have a cap on what you can receive for pain and suffering. Some states do; some don’t. But whatever you do talk to a lawyer! This is vital … unless you’re willing to settle for far less than what you should get … cap or no cap.
An injury lawyer won’t charge you anything for information and will probably represent you without any money up front. If you learned anything from your past experience you will talk to an injury lawyer. Most will charge you only if you win. Flip open the Yellow Pages … they’ve got scads of ads. Sure, they’ll take a percentage of your award … that’s how they make their money. But you’ll be much better off!
BTW, I’m not a lawyer. Wish you the best!
